Taichung Autonomous Statute on Pet Carcass Disposal and Pet Life Memorial Service Management

Chapter 1 General Principles

Article 1 Taichung has expressly drafted this autonomous statute in order to prevent the casual disposal of pet carcasses and safeguard the health of city residents, environmental sanitation, and manage the pet life memorial service industry.
Article 2 The competent authority of this autonomous statute is the Agriculture Bureau of Taichung Government.
Article 3 Terms used in this autonomous statute are defined as follows:
(1) Pet carcasses: Refers to the remains of dogs, cats, and other animals kept or cared for enjoyment or companionship.
(2) Pet carcass disposal facility: Refers to crematoriums specifically for pet carcasses, memorial halls, pet memorial parks, and pet ash storage facilities, as opposed to incinerators and landfills used for the disposal of general waste.
(3) Pet life memorial service industry: Refers to profit-seeking businesses engaged in pet life remembrance services, cremation, burial, ash storage, tree burial park management, and ash sprinkling services, and can be differentiated as pet carcass disposal facility operators and pets life remembrance service businesses.
(4) Pet carcass disposal facility operators: Refers to businesses engaging in pet carcass cremation, pet remembrance park management, memorial, and ash storage services.
(5) Pet life remembrance service businesses: Refers to businesses engaging in contracted handling of final pet care and pet life memorial services.
(6) Cremation facilities: Refers to facilities for the cremation of pet carcasses or storage of ashes.
(7) Remembrance halls: Refers to facilities for holding pet remembrance ceremonies.
(8) Pet remembrance parks: Refers to places where pet tree funerals, sprinkling of ashes, or burials are performed.
(9) Pet ash storage facilities: Refers to columbariums, columbarium walls, or other facilities where the ashes of pets may be kept.
(10) Tree burial: Refers to pet remembrance parks where pets' ashes may be placed in the earth, and flowers or trees planted in these places, or where pets' ashes may be buried near the roots of trees.
(11) Ash sprinkling: Refers to pet remembrance parks where pets' ashes may be sprinkled on the grass, in flower beds, or amidst trees.
(12) Burial: Refers to pet remembrance parks where pets' ashes may be stored in the ground after pet carcasses or remains have been cremated.
(13) Pet ash re-processing equipment: Refers to equipment used to transform pet ashes resulting from cremation to small pellets or to a smaller volume.
Article 4 Pet carcasses must be cremated, and may not be hung from a tree, buried in the ground, thrown into water, or casually discarded in other places where the placement of waste is prohibited.
Pet carcasses that have been disposed of by the pet owners shall be handled as required by the Waste Disposal Act.

Article 5 The facilities in subparagraphs 2, 6, 8, 9, and 13 of Article 3 should comply with relevant land use control regulations.
Article 6 The Agriculture Bureau shall establish a pet carcass disposal management unit and manage the pet life memorial service industry, and may establish pet carcass disposal facilities.
The public may turn pet carcasses over to the Agriculture Bureau or pet life memorial service industry for disposal.
In the foregoing paragraph, pet carcasses turned over to the Agriculture Bureau may be disposed of by a lawful business under commission.
The Agriculture Bureau shall determine management regulations governing pet carcass disposal procedures, fee collection standards, and other matters to be complied with.
Chapter 2 Assistance and management
Article 7 Pet life memorial service businesses must complete corporate, limited partnership, or business registration and apply to the Agriculture Bureau for a permit before they may operate.
The Agriculture Bureau shall determine management regulations governing the required criteria, facilities, and regular personnel, permit application procedures, permit deadlines and permit renewal and revocation conditions, permit fee collection standards, pet carcass disposal tasks, and other matters to be complied with of the businesses in the foregoing paragraph.
Paragraph 1 Such businesses must join the city's pet life memorial service industry association or pet business association as members at least one month before going into operation.
  The associations in the foregoing paragraph must cooperate with the Agriculture Bureau and assist members in implementing pet life education tasks.
Article 8 After a pet life memorial service business obtains a permit, it must go into operation within six months; if a business has failed to go into operation before this deadline, and the Agriculture Bureau shall revoke its permit. However, businesses with legitimate cause may apply for extension of this period, and such extensions shall be limited to a period of three months.
Article 9 Pet life memorial service businesses shall determine operating regulations in accordance with their service criteria, and must announce and implement these regulations after reporting them to the Agriculture Bureau and obtaining the Bureau's approval; these regulations shall be available for reading by consumers at the business's premises and on the business' website; likewise in the case of revisions.
The operating regulations in the foregoing paragraph shall specifically state the following items:
(1) Service items provided.
(2) Fee collection standards for each service, and criteria for the adjustment of fees.
(3) Restrictions on and conditions for the use of consumers' basic information.
(4) Method of providing compensation in cases when consumers' rights and interests have been harmed.
(5) Handling of consumer complaints and other matters concerning users' rights and interests.
(6) Other service criteria.
The operating regulations implemented by pet life memorial businesses may not harm consumers' rights and interests or allow unequal treatment.
Pet life memorial service businesses' model service contracts signed with consumers shall specifically state the matters in the various subparagraphs of Paragraph 2, and must be reported to the Agriculture Bureau for approval before use; such model contracts not may violate the requirements of this autonomous statute and the business's operating regulations; likewise in the case of revisions.
Pet life memorial businesses must establish individual service contracts with consumers based on their approved model service contracts.
Article 10 Pet life memorial businesses shall publicly display their relevant permits, products or service items, prices, fee collection guidelines, and business hours in readily visible locations at their place of business.
If requested by consumers, pet life memorial businesses shall provide fee breakdown tables and receipts when collecting payments for products or services.
Article 11 When pet carcass disposal facilities are in operation, if they use cremation as a disposal method, should comply with stationary pollution source air pollutant emission standards, stationary pollution source dioxin emission standards, and other relevant laws and regulations.
Article 12 Pet carcasses must be kept in a sealed condition during the transport process; pet carcasses must be refrigerated (frozen) prior to cremation.
Chapter 3 Penalties
Article 13 Those who violate the requirements of Paragraph 1, Article 7 by operating a pet life memorial service business without a permit shall be fined from NT$20,000 to NT$100,000, and shall be ordered to suspend operation; those that refuse to suspend operation shall be fined per violation.
Article 14 Those pet life memorial businesses that violate the requirements of Paragraph 2, Article 7 concerning the criteria, facilities, and regular personnel that must be possessed by pet life memorial businesses shall be fined from NT$15,000 to NT$75,000 and ordered to make improvements within a limited time period; those that fail to make improvement before the deadline shall be fined per violation.
Article 15 Those pet life memorial businesses that violate the requirements of Article 9 shall be fined from NT$8000 to NT$40,000 and ordered to make improvements within a limited time period; those that fail to make improvement before the deadline shall be fined per violation.
Article 16 Those pet life memorial businesses that violate the requirements of Paragraph 2, Article 10 shall be fined NT$6,000 to NT$30,000 and ordered to make improvements within a limited time period; those that fail to make improvement before the deadline shall be fined per violation.
Article 17 Those that violate the requirements of Paragraph 1, Article 4, Paragraph 1, Article 10, or Article 12 shall be fined from NT$3,000 to NT$15,000, and shall be fined per violation.
Those pet life memorial businesses that violate the management regulations specified in Paragraph 4, Article 6 concerning pet carcass disposal procedures, fee collection standards, and other matters that must be complied with shall be fined from NT$3,000 to NT$15,000, and shall be fined per violation.
Chapter 4 Supplementary provisions
Article 18 This autonomous statute shall take effect one year after it has been publicly announced.
